Terms and Conditions preamble: 

Milki Train Limited is the seller of products and services on the site. The commercial site www.milkitrain.com (hereinafter "Le Site") is an e-commerce site accessible via Internet, open to any user of the network.

It is operated by Milki Train Limited (hereinafter referred to as Milki Train), whose registered office is Unit C, 8/F, King Palace Plaza, No.55 King Yip Street, Kwun Tong, Kowloon, Hong Kong registered in the Register of Hong Kong companies under number 2870876.

The Site enables Milki Train to offer its products (hereinafter "Products") for sale in Hong Kong and abroad. The Site is reserved for individuals and prohibits traders.

These Terms and Conditions (hereinafter "Terms") govern your use of the Site and Services (hereinafter "Services") that may be proposed and would be out buying from the Site.

Any use of the Site constitutes full acceptance by the Customer of these Terms. Acceptance of Terms is done by checking the "I agree fully with the Terms and Conditions of Sale" when creating an account.

This acceptance is necessarily full, acceptance subject is null and void.

In case of modification of these Terms, the Terms and Conditions that apply are those in effect on the date of use of the Services or the order.

The present GCS (General Conditions of Sale) is available for consultation in English.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

We reserve the right to refuse service to anyone for any reason at any time. 

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

Art. 1: Products

The essential characteristics of products are available on the website in each product sheet.

We disclaim any liability for printing errors on our website. We strive to ensure that the presentation of our products is as close to real life as possible when it comes to shape and colors, but we cannot guarantee that all images exactly reproduce a product's true appearance.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

Certain products or services may be available exclusively online through the website.

These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

We reserve the right for the possibility that an item may be out of stock before we have had time to update our web shop. If one or more of the items in your order are out of stock we will inform you by email, adjust your order and payment and send you the remaining products to you.

We reserve the right to adjust prices, and any incorrect prices, before or after handling an order.

The Customer can then cancel the order for the item or items involved and be reimbursed, if applicable, any amounts already paid by crediting the corresponding price to the credit card used for payment no later than 30 bank-account days.

Art. 2: The Price

Product prices sold on the Site are per item and reference and are mentioned (USD) United States Dollars.

Prices for our products are subject to change without notice. 

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

The product prices are those indicated on the Site regardless of the place of delivery and include all Hong Kong taxes, excluding costs port, which are at the customer’s expense (for more information see Art.8).

It is precised that customs duties and any taxes charged on delivery in certain countries in which the products are likely to be delivered, are not included in the price and are at Milki Train’s expense (see Art. 9 for information about customs duties when returning a Product)

Any change to the rate of Tax will be reflected in the prices of items, from its entry into force. The applicable prices are the prices displayed on the Site at the time of ordering.

Art. 3: Registration

When ordering, the client is asked to an account to see her/his/their pre-entered data and to receive promotional offers dedicated.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Customer must also choose an e-mail address and a password that will be requested every time she/he/they want(s) to access.

Your personal information is protected by a password so that you, and you alone, have access.

Milki Train recommends the Customer to not disclose it to anyone.

The Customer must also disconnect from their profile and close the browser window after each work session.

The Client is the one responsible for the confidentiality of their password. The Customer alone bears the consequences of any unauthorized use of their password.

According to the law of January 6, 1978, the Customer has a right of access to personal data relating to it may use by writing to the Customer Service address hello@milkitrain.com and, without prejudice to the rights it has also oppose for cause processing of the data.

Art. 4: Order Steps completion of the sale: 

  1. The Customer types address www.milkitrain.com

  2. The Customer adds items to their shopping cart.

  3. The Customer fills out the form to create an account.

  4. The Customer verifies the elements of her/his/their command, identify and correct any errors made when entering through the issuance of an order summary.

  5. The Customer verifies and accepts expressly the General terms of sale of Milki Train.

  6. The Customer validates the order, the total price and the price all inclusive, clicking on "Pay My Order".

  7. The Customer receives an electronic receipt that includes the elements of the order. The order will not be confirmed until payment is accepted by the Customer's bank and receipt of the amount of the order by Milki Train.

  8. The Customer receives a confirmation of the order electronically.

  9. The Customer receives the parcel at the delivery address indicated by her/him/them in her/his/their order.

The summary of the order will also be available on the Website in the "My Account" category "my orders".

All orders will be confirmed after payment acceptance. After the payment, a confirmation of the order is sent to Milki Train's Customer by email to the email address specified by the latter.

Customer agrees that the bill be considered as evidence of the contractual relationship between parties. The Client will be able to print the invoice sent with the order confirmation.

Some products are available for pre-order, that is to say they are out of stock, but the stock will be replenished: in this case, the client is invited to pre-order and replenishment time is indicated below the "pre-order".

The payment procedure is the same. The pre-ordered products are delivered independently of the rest of the order, within the time specified in the pre-order.

Art. 5: Retention of Title

Products remain the property of Milki Train until full payment is received each order.

Art. 6: Terms of payment

Full payment must be made when ordering.

Payments cannot be considered as a deposit or deposits. No sending in against delivery will be accepted for any reason whatsoever.

Customers can pay their order by credit card (Visa, Mastercard, Amex) and Apple Pay via the implementation by Stripe secure platform (www.stripe.com).

All of your payment information is passed through a secure connection, ensuring you a very high level of data security.

Pursuant to the provisions of Article L 132-2 of the Monetary and Financial Code given an undertaking to pay through a credit card is irrevocable.

Any order placed on the Site constitutes a guarantee by the Client that has all the necessary permissions to use payment methods available on the Site. Milki Train reserves the right to suspend or cancel any order if it encounters difficulties in collecting payment.

Our clients can choose to save their credit card information in order to make their next purchases easier. Their credit card information will be securely store by Milki Train but by no mean disclosed to a third party.

Art. 7: Anti-fraud

Milki Train reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order.

Any resale of products purchased on the Site is strictly prohibited.

Art. 8: Delivery

Once Milki Train team has received the Customer order, we will email an order confirmation to your e-mail address.  

The order confirmation contains details of the products, prices, payment methods and delivery address. Please check that your order confirmation is correct. If something regarding your order is incorrect, please contact our customer care at: hello@milkitrain.com immediately. If an item is out of stock we will let you know via e-mail at the earliest possible opportunity. If you are under18 you must have parental permission to place an order with us.

For any order placed on the Site, we make a commitment to prepare your order in 24 to 96 hours (except for weekends and holidays) and in maximum 10 working days in periods of strong activities (Christmas, sales, etc.), unless specified otherwise on the product page.

At the time of the seizure of her/his/their order, the Customer has to choose the mode of delivery proposed on the Site and the address of the delivery:

- SF Express for delivery in Hong Kong (US$4 Flat-rate / 2-3 working days) or a free pick-up at our warehouse in Sai Ying Pun from Monday to Friday (except Bank Holidays) from 9 am to 5 pm, the pick-up needs to be scheduled within 5 working days after the order confirmation has been received

- Hongkong Post for delivery abroad (US$10 Flat-rate / 7-10 working days) 

Worldwide delivery is free for any order above US$85 except for express delivery.

- For worldwide express delivery, please choose: UPS Saver International (US$40 Flat-rate / 3-4 working days)

For deliveries outside Hong Kong, customs fees are at Milki Train’s expense except for orders over US$780.

*Please be aware that all orders exceeding US$780 will be subject to additional government duties and fees.

These charges are solely determined by the country of destination customs authorities. We cannot predict the amount of customs duties and taxes you will be charged upon delivery

Delivery address:

The Customer can ask ordered Products to be delivered to her/him/them in her/his/their place of residence, at her/his/their office, at a third person, on her/his/their holiday resort, etc. She/He/They also has/have the faculty to make deliver articles to one of the physical persons of its choice.

In case of error in the title of the address and phone number of the Customer, Milki Train cannot be held responsible for the impossibility to deliver one or several articles (ordered).

In case of absence during a delivery at the address indicated by the Customer in Hong Kong, SF Express will make re-delivery attempt or the consignee can follow the instruction of 'Delivery Absence Notice' to arrange free re-delivery. If delivery attempt fails again or the consignee cannot be contacted, SF Express will contact the Milki Train for more information.

After this deadline, the parcel will be sent back to the company Milki Train.

In case of absence during a delivery at the address indicated by the Customer outside Hong Kong, a calling card is normally deposited by the Post: the Customer can then remove her/his/their parcel with the post office provided with an ID card in 14 calendar days according to the date of the deposit of the calling card.

In case of absence during a delivery UPS at the address indicated by the Customer outside Hong Kong, the Customer has the possibility, on the site of UPS, by entering the field Numbers of follow-up or calling card InfoNotice of:

- If a signature is necessary, make deliver the sending to an available neighbor.

- Organize the removal of the sending in a customer center UPS.

- Reschedule the delivery date of the sending for a day when you can receive it.

- Make deliver the sending to a different address.

The Customer can follow the state of progress of her/his/their order, provided with her/his/their parcel follow-up number, on web sites given by Post, SF Express, UPS:

https://www.ups.com for the UPS delivery

Every delivery is considered made from provision of the product with the Customer by our carriers, realized by the follow-up of delivery proposed on the web sites of our carriers evoked this above.

Uncollected parcels:

In respect of uncollected goods, we reserve the right to charge for shipping, return shipping, administration and invoicing.

Lost package:

If 7 working days after the expedition of the parcel, the post office or the system of follow-up of delivery proposed on the web sites of our carriers evoked above fail to have track of this parcel, the Customer then can send an email to the Customer Service of Milki Train which will then open an inquiry with the competent services.

Times of definitive answer of our carriers vary of one to four weeks as from the consideration of the case by the services of the company Milki Train.

The Customer can, in this stage, cancel her/his/their command with the Customer service because of the undergone delay and ask for the refund of her/his/their order. The parcel, if it is found, will be sent to Milki Train and the Customer will be automatically refunded within 7 working days.

When the Customer wishes, on the contrary, to pursue her/his/their command and to receive her/his/their product in spite of the undergone delay:

- If the parcel is found, it is sent to the Customer: the procedure of reception follows then its normal price (warehouse of the parcel or the calling card).

- If the parcel is declared lost (the definitive answer is often formulated for the maximal deadlines, is four weeks), Milki Train informs then the Customer and commits to the refund of the parcel (products and postal charges) within 7 working days.

In any case, the delivery of our products for the deadlines can intervene only if the Customer is up to date of her/his/their obligations.

It is up to the Customer to verify the parcel on arrival and to make any reserves and complaints which would seem justified, even to refuse the parcel, if this one may have been opened or if it shows obvious tracks of deterioration.

The aforementioned reserves and the complaints must be sent to the Post office by registered letter with recorded delivery.

Force Majeure:

In the case of force majeure Milki Train’s obligations are suspended. If the period of force majeure exceeds two months both the customer and Milki Train have the right to revoke this agreement without any liability to pay damages. Force majeure refers among other things to industrial disputes, illness among personnel, transport disruptions, import/export prohibitions, natural disasters, abnormal market decline, major accidents and blockades etc., regardless of whether they have occurred at Milki Train or one of its suppliers.

Art. 9: Returns

The Customer has 15 (fifteen) calendar days from when she/he/they receive her/his/their order to return her/his/their purchase for a refund if she/he/they is/are not happy. The items must be returned in their original condition and packaging, labels must still be attached.

A full refund of the item(s) returned will be issued to the original method of payment, minus the shipping charges. 

Milki Train will only be responsible for shipping charges if the return is the result of our error.

Milki Train doesn't operate a standard exchange service. If the Customer wants to order an item in a different size, a different design or another colour, she/he/they can just place a new order in our online shop. 

Please note that if the Customer was subject to a customs fee, Milki Train is unable to refund this fee for her/his/their order. 

Please note that e-gift cards are non-refundable and are valid for up to 12 months from the purchase confirmation date. 

In case you wish to return an article for an order in which you have already returned another article, or have been gifted an item you wish to return, please contact us for second returns at: hello@milkitrain.com.

For domestic returns, the Customer can return her/his/their items by scheduling an appointment to drop her/his/their items directly at our warehouse in SYP, Hong Kong (Monday to Friday from 9 am to 5 pm), the Customer must send us an email at: hello@milkitrain.com to schedule the appointment and we will reply to her/him/them within 2 working days.

Otherwise, please follow the “returns steps” below.

Returns steps:

  1. You can return any product you wish to, except for e-gift cards, via our website

  2. To send your demand of refund, you need to click on “Returns Center” under the “Help” section on our website, either on the Footer or the Main Menu

  3. You will need to insert your order number along with the email address you used to purchase your items, after putting the relevant information, you need to click on “Find your order”

  4. Select the relevant product(s) you wish to return, then click on “Next”

  5. Select a reason, then click on “Next”

  6. Select “Refund to original payment method”, then click on “Next”

  7. Select “Ship with any carrier of your choice”, then click on “Next”

  8. You will then receive a confirmation by email

  9. Once we approve your refund request within no more than 2 working days, you will receive another email approving your return request with shipping instructions

Returns must be sent at Milki Train Hong Kong’s address:

and are at the client’s expense including possible customs duties.

The risks of returns are chargeable to the Customer. The Customer is thus strongly incited to send back the parcel by every possible means which brings the proof of its sending and date (recommended with acknowledgment of receipt, tracking number, etc.).

The Customer can insert the parcel tracking number in the email she/he/they received which approved your return request.

The product(s) must have returned in mint condition, in its original packaging, labels must still be attached.

The product(s) must be accompanied by the print off of the Customer’s confirmation of purchase previously emailed to her/him/them and a note specifying her/his/their RMA number (that can be written by hand on the print off).

In case of the absence of the confirmation of purchase email inside the parcel, Milki Train cannot proceed to the refund.

The incomplete, worn, washed, damaged, carried or made dirty returned Products will not be taken back.

For the refund: 

The returned Product(s) will be paid off to the Customer for a maximum deadline of 30 (thirty) days as from their reception by Milki Train, however, in many cases, the Customer will receive a refund more quickly. 

Once the received Product(s) is/are checked and accepted by our services, the refund will be made by a credit of the amount to be paid off on the bank account of the Customer used during the transaction.

Art. 10: Legal Guarantees

Products enjoy guarantees of conformity and hidden defects.

Notwithstanding the withdrawal period provided for in Article 9, in the event that the goods delivered do not conform in kind or quality about the specifications in the delivery, the Customer must notify the Customer Service by writing to the address the hello@milkitrain.com, but no later than 14 days after collection of the consignment, and provide a detailed description of the fault along with a clear picture of the Products showing the hidden defects or non-conformity issue.

The Customer will then receive an email with instructions to return the Products concerned.

Goods must be returned in new condition in its original packaging and accompanied by the return package to the address on the return form.

In the absence of the return label Milki Train may not proceed with the exchange of the returned product. Upon receipt of the goods returned by the Customer, we will inspect it thoroughly and notify her/him/them via email whether she/he/they are entitled to a replacement or refund (if any) within a reasonable period. Milki Train will process the replacement or refund as quickly as possible. In any case, Milki Train will notify you via email whether you are entitled to a replacement or refund in respect of the defective goods within thirty (30) days of receiving your returned goods.

If a defect has occurred, Milki Train will refund the Customer for the defective goods in full, including the delivery charges. Any sum will always be refunded in the same manner it was paid.

If the product is no longer available, Milki Train will notify the Customer by email and offer it to receive a credit or refund of the order of the amount of the returned product.

The provisions hereof will not affect your legal rights under any laws and regulations in force.

The withdrawal period does not begin to run after receipt of the new product.

Art. 11: Milki Train Responsibility

Milki Train is not responsible if the Linked Site is inaccessible or has access to any bugs or any reason whatsoever anomalies.

Milki Train reserves the right to put forward a third party on the Site in any manner whatsoever, and is not responsible for third party sites to which visitors are directed from the Site.

Accuracy, Completeness and timeliness of information:

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. 
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. 

Confidentiality of personal data: 

Personal data collected on the Site www.milkitrain.coms are required to process the order. In an order placed on the Site by any new customer, the database is enriched with information about him, that will, thereafter, to better meet their expectations and facilitate assistance services provided by Customer Service.

According to the law of January 6, 1978, the Customer has a right of access to personal data relating to it may use by writing to the Customer Service address hello@milkitrain.com and, without prejudice to the rights it has also oppose for cause processing of the data.

Risk and Title:

The risks of the goods shall be borne by the Customer once it has been delivered to the address designated by her/him/them. Ownership of the goods will only be transferred to the Customer after we have received full payment of all sums due in respect of the goods (including delivery charges) or upon delivery (as defined in Article 8 above) (if delivery is later than payment).

Intellectual Property Rights: 

All products and texts, comments, photos, trademarks, artwork, concept, illustrations and images from the Site are the exclusive property of Milki Train and are protected by intellectual property rights in Hong Kong and in the world. Total or partial reproduction of these materials or the Site is strictly prohibited.

Governing Law and Jurisdiction: 

In case of translation of the Site Terms and the English language prevails for interpretation.

These Terms are governed by Hong Kong law for issues. Any dispute arising out of their validity, interpretation, and enforcement subject to the exclusive jurisdiction of the courts rule Hong Kong except mandatory law procedure.
